Terms & Conditions

Who we are and what these terms cover
100 Lunches (“100 Lunches”, “we”, “us”) operates an online marketplace where a guest can book and pay for a lunch - in person or by video - with a host who has made time available. These Terms & Conditions form a binding agreement between you and us, and apply every time you use the platform. By creating an account, booking a lunch, or hosting one, you accept them.
We are not a party to the lunch itself. The agreement to meet is between the guest and the host. We provide the platform, take payment, hold it, and release it according to the rules below. We do not employ hosts, supervise lunches, or guarantee what happens at one.
These terms work alongside our Privacy Policy and Cookie Policy.
Using 100 Lunches
- You must be at least 18 years old and legally able to enter contracts. The platform is not for children.
- One account per person. Your account is personal to you - do not share your login or let someone else book or host under your name.
- The information on your profile must be true and current. Impersonating another person, using a false identity, or misrepresenting your background is a breach of these terms.
- Every account starts as a guest. You may additionally apply to become a host, and you can switch between the two roles at any time once approved.
- You may not use the platform to send spam, harass or abuse anyone, post unlawful or explicit material, scrape or copy other users’ data, solicit sexual services, promote unrelated commercial offers, or interfere with the platform’s operation or security.
- You can report a profile, a message or a booking to us at any time from within the app. We review reports and may act on them under the suspension section below.
Hosts
- Hosting requires an application and our approval. Approval may involve an identity or background screening carried out by a third-party provider, and we may decline or revoke host status at our discretion.
- Before you can be booked you must connect a payout account with our payments provider. The provider determines the currency you are paid in; your menu prices and every offer you receive are in that currency. Until payouts are connected you will not appear in search results and guests cannot book you.
- You set your own menu prices and publish your own availability. Prices must be at or above the published minimum for your currency.
- You are responsible for your own tax obligations on money you earn through the platform, including any GST or income tax. We are not your employer, and we do not withhold tax on your behalf.
- Approval as a host is not an endorsement, a recommendation, or a warranty by us about you, and identity screening is not a guarantee of anyone’s conduct.
Bookings, offers and payments
- Choosing a time. When a guest selects an available slot we hold it for approximately five minutes so they can complete checkout. If checkout is not completed, the hold lapses and the slot returns to the calendar.
- Offers. A guest may pay the host’s asking price, or make a different offer - higher or lower - provided it is at or above the minimum for the host’s currency. The host sees both the offer and their own asking price before deciding.
- Authorisation and acceptance. Payment is authorised when the booking is made and the host then has 24 hours to accept or decline. If the host does not respond in time, the request is automatically declined. Where a host has enabled automatic acceptance, requests at the full asking price are accepted immediately.
- If the host declines. The booking is cancelled and the guest’s money is returned in full, including any platform fee. 100 Lunches absorbs the processing cost.
- Platform fee. We charge a platform fee on each completed booking, deducted from the host’s payout. The current percentage is shown in the app before you confirm a booking and on the host’s earnings screens. We may change it for future bookings; the fee applied to a booking is the one in force when the booking was made.
- Currency. Prices are charged in the host’s payout currency. Where we show an amount converted into your preferred currency, it is an indicative estimate using a daily exchange rate and is not the amount your bank will charge. Your card issuer sets the final conversion rate and may add its own fees.
- Payouts. After a lunch is completed, the host’s payout is scheduled and released to their connected payout account after a short holding period, net of the platform fee. Payments and payouts are processed by our third-party payments provider and are subject to that provider’s own terms and verification checks.
- You must not arrange or take payment for a lunch found on 100 Lunches outside the platform, or encourage another user to do so.
Cancellations
- Before a host accepts. A guest can cancel a pending request at any time and is refunded in full.
- Guest cancels a confirmed lunch, more than 7 days before it starts. The guest is refunded the amount paid less the platform fee, which we retain. No payout is made to the host.
- Guest cancels a confirmed lunch, within 7 days of the start time. The booking is not refunded and the host is paid as though the lunch had taken place. This protects hosts who have set aside the time at short notice.
- Host cancels a confirmed lunch. The guest is always refunded in full, including the platform fee, and the host receives no payout. Repeated host cancellations may lead to removal of host status.
- Refunds are returned to the original payment method. The time it takes to appear depends on your bank or card issuer.
No-shows and disputes
- Either party can report that the other did not attend, for up to 5 days after the scheduled start time. You can attach a short explanation and supporting photos.
- The other party is notified and can agree or contest. If they do not respond within 5 days, the report resolves in favour of the person who made it.
- Where a guest did not attend, the host is paid. Where a host did not attend, the guest is refunded. Where both agree the lunch happened, the booking is completed normally.
- If the two accounts of what happened conflict, 100 Lunches reviews the reports and the evidence and decides how the money is released. That decision is final for the purposes of releasing funds held on the platform. It does not affect any right you have to pursue the other user directly, or any right you have under Australian Consumer Law.
- Deliberately false no-show reports are a serious breach of these terms and can result in immediate suspension.
Conduct at the lunch
- You are responsible for your own safety. For in-person lunches, choose a public venue, tell someone where you are going, and leave if you feel uncomfortable. We do not vet venues and we are not present at the lunch.
- Unless agreed otherwise, each person pays for their own food and drink. The booking price buys the host’s time, not a meal.
- For virtual lunches, the host provides a working meeting link ahead of time and both parties should join on time.
- Treat the other person with respect. Discrimination, harassment, threats, and unwelcome advances have no place on the platform, at the lunch or in messages.
- Anything discussed at a lunch is between the two of you. Nothing said is professional, legal, financial or medical advice from 100 Lunches, and we make no promise about the usefulness of any lunch.
Content, reviews and messages
- You keep ownership of your profile text, photos and reviews. You grant us a non-exclusive, worldwide, royalty-free licence to host, display and distribute that content for the purpose of operating and promoting the platform, for as long as you keep it on the platform.
- Only post content you have the right to post. Do not upload photos of other people without their permission.
- Reviews must be honest, first-hand accounts of a lunch that actually happened. Do not trade, buy or pressure anyone for a review. We may remove reviews that are abusive, off-topic, contain personal information, or breach these terms.
- Booking messages exist so guests and hosts can arrange their lunch. We may review message content where it is reported to us or where we reasonably suspect a breach of these terms, fraud, or a risk to someone’s safety.
Suspension and termination
You can close your account at any time from your settings. Where you have upcoming bookings, an unresolved dispute or a pending payout, closure completes once those are settled.
We may suspend or terminate an account, remove content, revoke host status, or withhold a payout where we reasonably believe there has been a breach of these terms, fraudulent or unlawful activity, a risk to another user’s safety, or a chargeback or payment dispute. Where it is practical and appropriate to do so, we will tell you why. Money already owed for a completed lunch is not forfeited by suspension unless it is the subject of a fraud or dispute investigation.
Liability
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Where our services come with a consumer guarantee that cannot be excluded, our liability is limited (at our option) to resupplying the service or paying the cost of resupply.
Subject to that:
- The platform is provided on an “as is” basis. We do not warrant that it will be uninterrupted or error-free.
- We are not liable for the acts, omissions, statements or conduct of any other user, before, during or after a lunch, whether online or in person.
- We are not liable for indirect or consequential loss, or for loss of profit, income, opportunity or reputation.
- Our total liability to you in connection with a booking is limited to the amount paid for that booking.
- You are responsible for loss we suffer because you breached these terms or the law, to the extent it was caused by you.
Changes to these terms
We may update these terms as the platform changes. When we make a material change we publish the updated version here with a new date and ask you to accept it before you continue using the platform. Bookings already confirmed continue under the terms that applied when they were made.
Governing law
These terms are governed by the laws of New South Wales, Australia. You and 100 Lunches submit to the non-exclusive jurisdiction of the courts of New South Wales and the courts able to hear appeals from them. If any part of these terms is found unenforceable, the rest continues to apply.
